On September 30, 2008, plaintiff filed a complaint in St. Louis County, Minnesota against U.S. Steel alleging that under U.S. Steel’s normal procedures, Minnesota hourly employees are not paid for all time worked as defined by Minnesota law. The complaint alleges that employees are required to swipe at the entrance gate up to eighteen minutes before their pay begins and remain on company grounds for six minutes after their pay ends. Plaintiff seeks compensation and declaratory relief for himself and members of the proposed class. The proposed class includes persons who are or were U.S. Steel hourly employees at either of the Minnesota facilities.

On October 27, 2008, defendant U.S. Steel removed the case to United States Federal District Court for the District of Minnesota.  On December 31, 2008, the court ruled that the case will remain in federal court.
